All About Insurance Fraud

Ever since insurance was invented, so was insurance fraud. There are many types of fraud, from life insurance fraud to auto fraud. This article will provide a general overview, while discussing the impact of fraud on society.
Most of the time, when someone commits fraud, it is for financial gain. Because of the nature of insurance policies, they are rife with potentials for exploitation. Commonly, insurance policies are exploited by individuals claiming more loss than actually occurred, or inflating the value of the item lost.
Insurance fraud is generally divided into two classifications - soft fraud or hard fraud. Soft fraud is the more common of the two, and is also called opportunistic fraud. This type of fraud occurs when an insured party inflates an already legitimate claim. Soft fraud, for example, happens when an insured individual is involved in a car accident and claims that more damage was done to the vehicle than is true. Soft fraud can happen at the start of a new insurance policy, when an individual purchasing a policy misrepresents their actually situation in order to get a lower premium. An example of this is if someone is buying a car insurance policy but lies about the number of miles on the vehicle to obtain a lower premium
Hard fraud is when someone plans a loss to receive an insurance payout. This type of fraud is usually executed with a fire, "stolen" automobile, or similar that the individual plans themselves. Sometimes entire crime rings are devoted to hard insurance fraud.
An example of life insurance fraud occurred in 2002 when a man named John Darwin disappeared during a canoe trip. His family collected on his life insurance, and he reappeared in 2007 with reported memory loss.
Auto insurance fraud is one of the most common types of fraud. It is estimated that in 1996 as much as 36 percent of auto-insurance claims were fraudulent in some way. Soft fraud in auto insurance fraud includes what was mentioned above, but also situations where a person claims an injury that did not actually occur during the accident in question, or if someone registers their automobile in a location that the insurance is less expensive. For instance, if a person lives in a major city, it is more expensive to insure the car, so they will register it with a suburban address in order to obtain a lower premium.
Hard insurance fraud is usually executed in a "crash for cash" scenario, which has several different varieties of staged crashes. One is the "classic rear-end shunt" where a driver will slam on their brakes, causing the car behind them to crash into them. Many times, the brake lights are disabled, but reconnected before an investigation is conducted. Another common "crash for cash" scenario is one called the "helpful wave shunt," where a driver waves another car ahead of them in a line of traffic, then crashes into them and denies ever waving.
Insurance fraud is a very real problem in the US, with 2006 losses estimated to be near $80 billion. It is estimated that 3-10% of all medical claims contain some element of fraud, resulting in billions of dollars in loss.

National Insurace Contributions for UK Expats - The Facts

There seems to be a lot of confusion regarding the payment of National Insurance Contributions and the benefits of the state pension for UK Expats.
What I want to achieve with this post therefore, is to give you an idea of the basic facts regarding the basic state pension and the necessary steps that you would need to take, should you want to make contributions on a voluntary basis and/or make up missed payments.
Armed with this information, you will then be in a position to make an educated decision on how to proceed.
Basic Facts:
To achieve a full basic state pension you need to have achieved a certain number of qualifying years. A qualifying year is a year where one of the following applies:
• you have sufficient income to pay National Insurance Contributions
• you are treated as having paid National Insurance Contributions
• you are credited with enough National Insurance Contributions
If you are a man born after the 6th of April 1945 or a woman born after the 6th of April 1950, then you need to achieve a total of 30 qualifying years in order to achieve the full basic state pension.
For tax year 2011/2012, the full basic state pension will be GBP102.15 per week. This will increase annually by the highest of prices, earnings or 2.5 per cent.
If you have less than 30 qualifying years, your pension will be reduced on a pro rata basis. E.g. if you only had 15 years, you would get GBP51.08 per week (15/30 = 50% of GBP102.15).
Step 1 - Find out where you are now.
Your first step should be to contact the state pension forecasting team in Newcastle and ask for a pension forecast.
This will tell you the number of qualifying years that you already have as well as the level of state pension that you can currently expect.
Their telephone number is +44 191 218 3600. If you contact them, they will then send you the completed relevant form for you to sign and return to them. (Remember, as with all communications with HMRC, to have your NI number handy when you call.)
Alternatively, if you want to speed the process up, you can download the relevant form from their website and send it directly to them. The address to send it to is:
State Pension Forecasting Team, The Pension Service, Tyneview Park, Whitley Road, Newcastle upon Tyne, NE98 1BA, England.
Allow them a few weeks to get back to you.
Step 2 - Make Voluntary Contributions
The next step, if you don't already do so, is to start making regular voluntary contributions. There are 2 types of contribution that you can make, either Class 2 or Class 3.
To qualify for Class 2 Contributions, you must have been 'ordinarily' employed or self-employed immediately before you went abroad. (If you are in doubt as to whether you qualify, contact National Insurance Contributions - International Caseworker Team on +44 191 225 4811).
If you don't qualify for Class 2, then you need to make Class 3 contributions.
Class 2 contributions have the following benefits:
• they count towards your State Pension when you retire
• they entitle you to the Employment and Support Allowance (previously known as Incapacity Benefit) and bereavement benefits when you return to the UK
Class 3 contributions have fewer benefits. Namely, they don't entitle you to the Employment and Support Allowance when you return to the UK.
In addition, Class 3 contributions are more expensive. For Class 2 contributions, the payment is equivalent to GBP2.50 per week (2011/2012). Class 3 payments are equivalent to GBP12.60 per week (2011/2012)
As you can see, wherever possible, it makes sense to pay Class 2 Contributions.
To commence contributions (Class 2 or 3) you need to complete the form CF83, which can be found on the last 2 pages of the NI38 document. You can find a copy by Google searching "NI38".
Payments can be made monthly by Direct Debit or with an annual payment.
Step 3 - Make Up Missed Years
If you haven't been making any contributions for some time and still do not have 30 qualifying years, then you can make up missed years going back for the last 6 years. Your State Pension Forecast (mentioned above) will tell you how much you need to pay to make up each of these years.
Instructions on how to make payments for these missed years will be on the forecast letter.

Why Ratings Are Important When Choosing an Insurance Company

Ratings can help you decide between competing and competitive health plans. Many believe that the best way to be sure that you get the right health coverage for your needs is to compare the ratings of several different insurance companies.

The individual company's competitive forces, changing fundamentals and financial strength are all taken into account when they are compared through the use of health insurance ratings. This is imperative because if the health insurance company will no longer be able to pay out future benefits or claims then naturally any other considerations become completely unimportant. These various ratings are available online and there are several different ways of computing these ratings, using companies such as Standard and Poor's Insurer Financial Health Strength Rating, Credit Watch and Fitch Ratings Insurer Financial Strength Rating. Ratings are normally done on a scale of "Triple-A" to "CC"; the insurance companies that have the notations "NR" have not yet been rated. Naturally, the health insurance companies that have the "Triple-A" rating are considered to have very strong financial stability characteristics and of course, those with the "CC" rating are believed to have weak or poor financial stability characteristics. Those companies with health insurance ratings of "BBB+" or higher are still considered secure, while those that have "BB+" or even lower are considered to be vulnerable.

The plus or minus sign (+, -) that may follow the ratings in the "AA" to "CCC" categories show what the relative standing is within the major categories that are rated. There are times when some companies will have health insurance ratings of "DDD" and it is normally used to designate that the company has either been given some kind of regulatory intervention or that they may have failed to pay out benefits in a timely manner.

You should keep in mind that these health insurance ratings do no take into consideration any kind of cancellation or surrender penalties, the likelihood of whether or not fraud may be used in order to deny any claims or the amount of the deductibles. Other things not taken into consideration are what the possible potential would be of certain foreign exchange restrictions possibly preventing or delaying any financial responsibilities being met.

Any of these ratings can be suspended, withdrawn or changed due to the change in the information that is provided by the health insurance companies; so be sure that you check the ratings that were done at different times.

The story is a common one. A house catches fire and the insurance company refuses to pay the claim or offers payment of less than 40% of the cost to repair the damage. The policyholder tells the company about the new flat screen TV in the family room but she no longer has her receipt...since it burned in the fire. Does she wait to repair the damage while fighting with the insurance company or does she give in and agree to sign a settlement for a lower value just so she can move on with her life?

Our need to resolve losses and move on with our lives equals big profits at insurance companies.

What do you do when you insurance company refuses to pay or delays paying a claim...be it auto, home, business or an accident involving your property?

The same question applies when an insurance company pays only a portion of a claim or deliberately undervalues a claim.

When unnecessary delays, undervaluing of claims occurs deliberately or a policyholder is rushed to settlement of a claim, it is called "bad faith."

In all states, an insurance company is obliged to act with the best interest of the client or policyholder. It does not matter whether you live in Texas or Maine. The legal obligations of an insurance company remain the same. The laws governing specifically when and how such matters are resolved in the courts can vary from state to state. However, the basic tenet governing how an insurance company must operate remains static.

When an insurance company fails to act in a fair and honest way toward its policyholders or is dishonest in any way, "bad faith" is said to have occurred.

Situations in which bad faith can occur vary widely, including auto insurance, life insurance, disability insurance, homeowners insurance, medical malpractice insurance, etc.

Examples of insurance bad faith include but are not limited to:

Delaying payment of claims for an unreasonable length of time

Denying coverage

Denying payment on claims

Failure to investigate a claim in a reasonable manner

Withholding benefits without cause

Underpayment of claims

Undervaluing claims

Unfairly refusing to settle or reimburse claims

Abusive behavior toward policyholders or unreasonable claims processes

Cancellation of insurance policy unjustly

Anyone can bring a civil action against an insurance company when the individual suffers damage due to an insurance company's behavior. Such claims can be brought against companies for auto, home, business, professional liability, health, life, disability, and other types of insurance.

Health insurance can be a little tricky in that employer provided insurance is limited by Federal laws known as ERISA, the Employment Retirement Income Security Act. In other words, if you get your health insurance through your employer and a claim is denied, your ability to sue that insurance company may be limited. The laws in this area are in a state of constant change so do not assume you cannot sue. Talk to an attorney first.

How does it work?

Insurance companies employ entire departments of people called actuaries. One definition of an insurance actuarial is "An Actuary is responsible for analyzing the possible outcomes of the types of events that could potentially cause policyholders to make claims against their insurance policies." That about says it all.

It is the job of actuarials to also weigh the likelihood litigation will take place in the case of a loss, the likelihood a policyholder will seek and obtain competent legal counsel, pursue a claim, etc. This is referred to as "risk management," and while these people do not make decisions regarding claims, they do provide the decision makers in insurance companies with the "odds."

On the face of it, forcing a policyholder to pursue litigation can make sound economic sense. If the claim is $50,000, the policyholder is going to have to spend a great deal of time getting their money. So, the claim gets lost, delayed, is undervalued all in a ruse to frustrate the policyholder and drive them to agree to settle for an amount much less than the actual value. It works all too often.

Payment of claims, however, is by no means an easy business. Insurance policies are complex and few policyholders carefully review their policies to assess the exclusions, omissions, etc. prior to filing a claim.

On the other hand, lawsuits have proven that ssome of the nation's biggest insurance companies have denied valid claims in an attempt to boost their bottom lines. These companies have even rewarded employees who would not pay claims, and when all else failed, engaged in outright fraud to avoid paying claims.

Stall. Delay. Fill out more forms. Wait them out!!!

Legal case histories are full of insurance companies routinely delaying claims, knowing full well that many policyholders will simply give up. Some have gone as far as to lock paperwork away in safes. Undoubtedly, the most shameful use of delay tactics has been by long-term care insurers, who often take advantage of their policyholders' age and ill health.

In the words of one regulator, "the bottom line is that insurance companies make money when they don't pay claims . . . They'll do anything to avoid paying, because if they wait long enough, they know the policyholders will die."

Four Common Types of Insurance Cover and How to Save on Them

The four most common types of insurance cover are life insurance, health insurance, car insurance and home insurance, though not in that particular order.

Life insurance is taken against the risk of death, which we are all at, by virtue of being alive. The idea behind taking life insurance cover is to ensure that one's dependants don't suffer financial distress in the event of their (the policyholder's) death. So in the event of death - once a person with life insurance has been certified as having died - it falls upon the life insurance provider with whom they had taken the cover to pay the policyholders survivors (who might include spouses, children and other dependants) money from the policy - whose amount is typically agreed upon at the policy-signing time. This is paid either in lump-sum or in smaller but regular amounts over a longer period of time.

So the way health insurance works is that the policyholder pays sums of money called premiums to the insurance provider, under the agreement that should the policyholder fall sick, the insurance provider would foot their medical bill, typically up to a pre-agreed level and at certain agreed health facilities to prevent fraud.

Car insurance is typically taken against the risk of 'road accident,' though other risks like car theft might also be covered in some cases. The agreement here is that the car owner continues to pay certain sums of money called premiums to the insurance provider, under the understanding that should the car be involved in a road accident (or get stolen, in the relevant types of cover), the car insurance provider would take up liability for loss the accident (or theft) causes, typically to a given pre-agreed extent; or upon the assessment of the loss by the assessors attached to the insurance provider.

Home insurance, on the other hand, covers against a variety of risks - from theft to fire - with an agreement where the policyholder pays the insurance provider certain sums of money called premiums on a regular basis, and with the understanding that in event of the home that is so insured suffering from the events against which it is insured, the insurance provider would take up financial liability for the loss incurred - typically up to a given level.

Now the common factor that is seen is all these types of insurance cover is 'risk.' What the insurance providers typically do, then, is to charge those of their customers who have 'higher risk profiles' higher amounts of money in terms of premiums, with those of their customers who are said to be at lower risk being charged lower amounts of money in terms of premiums. Herein, then, lies the way for one to reduce their insurance costs: by reducing their risk profile. Insurance Versus Warranty - What's the Difference?

When you are planning ways to protect the value of your assets, insurance is always something to consider. When you insure something, you are buying protection against the possible sudden loss of the value represented in whatever you are insuring. Each insurance "policy" is a contract between the insurance company and the person buying the insurance policy. There are four major areas for insurance of this type: Health, Home, Auto (and other vehicles such as boats), and Life insurance (such as term and whole-life).

There are two other types of contracts that customers get confused with the contracts listed above. The first of these is the life insurance contract that is primarily sold as a financial investment tool. While these still contain some form of life insurance, they are generally designed as a means of producing a guaranteed income stream later in life, or for reducing the impact of taxes when transferring estate wealth when the insured person dies. These are not the simple life insurance policies you get with term insurance. And they are more complicated than whole-life policies. The other type of contract is more like a product warranty, yet it is sometimes called insurance. Examples of this type contract include appliance warranties, or extended car warranties.

This department is usually a part of the state's office that regulates businesses involved with financial matters. The purpose of the department is to make certain the residents of the state are being treated fairly when buying insurance, or making a damage claim. Before a company is authorized to sell insurance in a state, it must show that it is following accepted procedures for the industry and has the capacity to pay on claims presented to it.

The state watches over these insurance companies, but so does the Federal Trade Commission (FTC). Home owners claimed the damage was caused by wind, which led to the problems with flooding.

The government does get involved in protecting the interests of the customer. They also attempt to provide a fair environment for the insurance companies. There are probably still claims cases for damage caused by Katrina that are in the civil-court process.

The types of insurance I am talking about here all pertain to the retail market. There are other types of insurance for businesses to cover the value of inventory, workers' health, construction liability, etc. This business is also regulated by the state and federal governments.

Earlier, I mentioned the product warranty. This is also a contract for protection. Customers used to feel satisfied with the manufacturer's warranty that was included with the purchase of the item. But now we are seeing third parties who want to sell us warranties that continue after the manufacturer warranty ends. For example, you buy a major brand TV from Sears and they attempt to sell you an extended warranty from a company that is neither the company who manufactured the TV nor Sears. The business of these service contracts is not regulated by the state and federal governments like the business of insurance is.

The product warranty is a form of insurance if you look at what it offers you. You pay a known fee for a contract to take care of servicing your product if it breaks during a certain time period. This protects you from potential high-cost repairs needed if the item fails to perform as intended. They don't usually compensate you for accidental damage. More correctly, these contracts are called service contracts.

Companies who sell these contracts can specify what is included and what is not included in their warranty. They can cover the item for certain types of use and not others. They can set time limits on when certain types of failure are covered. Basically, the coverage and the pricing are designed with a preference for earning the company money rather than providing you with protection. Furthermore, no one but the issuing company is assuring the customer that there is a strong company standing behind the validity of the service contract. These are the important differences between a service contract and a regulated insurance contract.

When you hear someone selling an automobile service contract claiming to protect you from an outrageously high cost for replacing the transmission in your car, ask yourself how likely that repair is to be needed and if the cost estimate is correct. Ask if the contract is insuring you against something that the car manufacturer is already covering (Do you drive a Hyundai or Kia? Check out the warranty they already offer you.) Service contracts cost the buyer more than the costs of likely repairs. That's how the companies make money. That might be okay if all you wanted was to avoid a catastrophic expense. But most of these contracts won't cover many of the repairs you are assuming they will cover. And they are not an insurance product.

What is a Subrogation Demand Audit?

First of all we have to loosely define subrogation, so. . .It is the "stepping into another's shoes" scenario that comes about when one party pays (due to legal or contractual obligation) for another parties wrongdoing. A simple example can be seen in auto insurance. For example, let's say you are in an auto accident and forced to file a claim under your own policy of insurance because the person that caused the accident (tortfeasor) either refuses to provide insurance information or simply doesn't have insurance. In this scenario, your own insurance company has to pay for the wrongdoing of the tortfeasor and by virtue of their payment to you, they step into your shoes and inherit the right to sue the person that caused the claim. Whew! Did you catch all of that?

Okay, so whether you did or didn't follow the whole scenario is beside the point. Let's just assume you get it, and so at this point if we use the above scenario, your insurance company could present a claim to "Mr. Accident Causer's" insurance company (if he had insurance). When you company makes this type of claim, it is called a subrogation demand.

So now the company receiving the demand could possibly use a subrogation demand audit. The audit is just that, an audit of the demand made by your company. Normally, an experienced adjuster or attorney will review the claim documentation and weed out any overpayment or cost difference based on administrative, statutory, or precedent based rules or laws. The auditor will search out the seemingly petty details that relate to claims cost and return a report to the claims office that received the subrogation demand. The result of a thorough subrogation demand audit is normally a substantial savings for the company receiving the demand. Differences in contractual obligations and civil obligations can make a big difference, and such things as parts availability or the failure of a company to utilize sound economic claims handling can also make a substantial difference in the amount demanded and the amount actually owed.
